Illinois’ Employment Laws

Beginning in March, 2021, the state of Illinois has amended employment laws to protect residents of Illinois in the workplace.

Some of the most significant amendments include:

  • The Illinois Human Rights Act now includes a definition of a conviction record and has strict requirements regarding the use of conviction records when determining employment.
  • The Illinois Business Corporation Act now requires businesses (domestic and foreign) to file their annual reports with the Illinois Secretary of State. They must also file an Employer Information Report with the Equal Employment Opportunity Commission (EEOC).
  • The Illinois Equal Pay Act now includes provisions that require private sector employers who have more than 100 employees in the state to file an equal pay certificate with the Illinois Department of Labor every 2 years. This certificate must include the ethnicity, gender, and race of every Illinois employee as well as their annual wages.
